(1) Originality and authenticity
Where photographs and recordings are treated as documentary evidence, the general
rule is that the original document must be produced and its authenticity proved.1
Originality normally refers to the original source from which the information was
recorded, and the requirement protects against errors, alteration and falsification.1 In
Welz v Hall, the court confirmed that the best-evidence rule requires the original where
the contents of a document are directly in issue.1
