1. INTRODUCTION
This legal opinion assesses the possibility of bringing a complaint to the United Nations
Human Rights Committee (HRC) under the First Optional Protocol to the
International Covenant on Civil and Political Rights (ICCPR) on behalf of Mr
Mbhekwe, a death row inmate in the Republic of Kamarara.
The matter concerns the constitutionality and human rights implications of Section 14
of the Criminal and Other Offences Act 15 of 1939, which imposes a mandatory
death sentence for murder.
Kamarara has:
Ratified the ICCPR and First Optional Protocol;
Ratified the Second Optional Protocol (aimed at abolition of the death penalty);
Adopted a Constitution with a Bill of Rights;
Ratified the African Charter on Human and Peoples’ Rights (ACHPR).
