Facts: A woman experiences repeated derogatory, gendered labels for assertive
behaviour.

1. Applicable Law

 The Constitution of the Republic of South Africa, 1996 – particularly s. 9
(Equality Clause), s. 10 (Dignity), and s. 12 (Freedom and security of the
person).
 Employment Equity Act 55 of 1998 (EEA) – if these remarks are made in a
workplace context, it’s harassment and discrimination based on gender.
 Promotion of Equality and Prevention of Unfair Discrimination Act 4 of
2000 (PEPUDA) – covers unfair discrimination and hate speech outside the
workplace.
 The 1993 Constitution is outdated, so only relevant historically — here, the
1996 Constitution applies.

Type of discrimination: Unfair discrimination on the basis of gender and/or sex,
possibly amounting to harassment.



2. Locus standi

Yes. The aggrieved woman is directly affected and thus has standing in terms of
both the Constitution (s. 38) and relevant statutes (EEA/PEPUDA).
