disabilities.” Critically discuss this statement, with specific reference to the Rights-Based
Approach.

The Rights-Based Approach (RBA) to inclusive education emphasizes the inherent dignity and
equal rights of all learners, particularly those with disabilities. Unlike deficit-based models that
focus on limitations, the RBA frames disability as a social construct and calls for the removal of
societal and environmental barriers (United Nations, 2006).
This approach aligns with Article 24 of the UN Convention on the Rights of Persons with
Disabilities (CRPD), which advocates inclusive education at all levels and lifelong learning. In
South Africa, this principle is embedded in the Education White Paper 6 (Department of
Education, 2001), which calls for a shift from a segregated system to one that values diversity
and supports full participation.
The RBA fosters accountability, ensuring that states and educational institutions are obligated to
create inclusive environments. It promotes non-discrimination, accessibility, participation,
and the individualization of support—all critical for achieving equity. Educational practices
such as Universal Design for Learning (UDL), curriculum differentiation, and assistive
technologies are inspired by this paradigm (Florian & Black-Hawkins, 2011).
