Question 1

Protecting Child’s Rights

A social worker plays an important role in protecting children’s rights during child
protection services. This responsibility is grounded in national legislation such as the
Children’s Act 38 of 2005 (South Africa) and international instruments like the United
Nations Convention on the Rights of the Child (UNCRC). This includes making sure the
child is involved in the process of participation, making decisions that are in their best
interest and treating the child with dignity. Below are the key ways in which a social
worker can uphold these rights, along with practical examples.

Participation

Participation means that children should have a say in matters that affect their lives. A
social worker should create a safe space where the child feels comfortable to speak.
The child should be asked about their feelings and preferences in a way that suits their
age and understanding.

Example: In a case where a child is being moved to a different home, the social worker
can ask the child who they feel safest with, or how they feel about living with a relative.
For younger children, the social worker might use drawings, games, or storytelling to
help the child express themselves.

2. Best Interest of the Child

The social worker must always put the child’s needs and safety first. This includes
making sure they have a stable home, access to education and healthcare, and
protection from harm. Every decision should support the child’s physical, emotional, and
mental development.
