SHORT ANSWER (10 points each)
1. List 2 risks of disclosure using email as communication.
Two risks of disclosure using email as communication is the lack of privacy as it may
contain sensitive information and data retention regarding metadata, which is hidden information
when sending files to the opposing counsel.
2. What happens to the attorney client privilege if the client tells a friend everything that
was said in the privileged conversation with the lawyer?
In this case, the client has waived such privilege by repeating the communication to a
third party who is not covered by the privilege.
3. List 2 security measures that may protect against breaches of security in using computers.
Two security measures that may protect against breaches is to protect your system with
passwords that are changed periodically and placing the computer in a place where a passerby
cannot see.
4. Under what circumstances may a lawyer disclose privileged information?
A lawyer may disclose privileged information if the lawyer’s professional competence is
questioned through criminal charges, when a lawyer represents two clients who later become
adversaries, and confidential communications about a future crime or fraud.
5. a. If the client is a corporation, what personnel are covered by the attorney client
privilege?
Paralegals that work in-house are covered by the attorney client privilege along
with in-house counsel.
