ADPP Police Powers
LEPRA, Section 11 (1) (2) - Identity may be required to be disclosed - Answer-(1) If a police officer
suspects they may be able to assist in the investigation of a serious indictable offence.
(2) If the officer proposes to give a direction
LEPRA, Section 21 - Power to search someone and seize and detain things without a warrant - Answer-
Police officer suspects they have:
- Stolen property or anything unlawfully obtained
- Anything used or intended to be used in or in connection with the commission of a relevant offence.
- Possession of a dangerous article in a public place that was being used or in connection with a relevant
offence.
- Has prohibited plant or drugs in their possession
LEPRA, Section 23 - Power to search persons for dangerous implements without a warrant in public
places and schools - Answer-- Police suspect on reasonable grounds the person is unlawfully in
possession of a dangerous implement
- In conducting a search at school police must allow a student to nominate an adult within the school
premises to be present.
