Key Cases:

- William Sindall Plc v Cambridgeshire County Council “Not so far as the seller is
aware” because this would amount to an assertion that the seller had made
reasonable investigations into the matter
- Gordon v Selico Ltd S cannot deliberately mislead B eg conceal physical defects or
answer enquiries dishonestly
- Patel v Daybells if SS failed to redeem mortgage, risk for the buyer in completing the
purchase on the basis of such an undertaking as technically the buyer purchases the
property whilst it is still subject to the seller’s mortgage. Held that BS was not
negligent in accepting an undertaking from SS (that the mortgage would be
discharged out of the purchase $ and that DS1 would be forwarded)
