Not punishable by imprisonment, and the party charged is not entitled to trial by jury or to have counsel appointed. Habeas Corpus Allows individuals unlawfully in prison or restrained of their liberty to file a Writ of Habeas Corpus in court. This demands the imprisoning official to bring the individual to court to determine if detention is lawful and if they should be released. Bail Allows a defendant to be released after criminal charges are filed, with the promise to appear at all future court dates. Bail can be cash, deposit in lieu of bail, or own recognizance, depending on the case and defendant's circumstances. Burden of Proof
