A. DEFINITIE

= Collectieve betrekkingen tussen werkgevers(organisaties) en werknemers(organisaties) op verschillende niveaus (federaal,
regionaal en onderneming)

<-> Individueel arbeidsrecht: verhouding tussen werkgever en werknemer (rechten en plichten bij uitvoering AOV, ontslag,...)

Wat komt grosso modo aan bod?

- Organisatie collectief overleg (tussen sociale gesprekspartners)
- Totstandkoming specifieke rechtsbronnen (o.a. CAO)
- Collectieve conflicten (vb. staking)

VRIJHEID VAN VAKVERENIGING

A. HISTORIEK




1. HET COALITIEVERBOD

Vroeger was het napoleontisch strafwetboek van toepassing (1810) waarin een samenspanningsverbod (art. 412 sw) of
coalitieverbod was opgenomen. (Verbod gold zowel voor WG’s en WN’s)

Wanneer men dat overtrad kon men een gevangenisstraf tot 5j krijgen of een geldboete.

Al onder het Voorlopig bewind werden door het decreet van 16 oktober 1830 alle beperkingen op de verenigingsvrijheid
opgeheven. Vrijheid van vereniging  art. 27 GW hield verband met de politieke vrijheden die men belangrijk vond bij de
totstandkoming van België. Artikel 23 Gw. Bekrachtigt dit door de Belgen het recht toe te kennen om zich te verenigen zonder
dat dit aan enige preventieve maatregel kon worden onderworpen.

Men behield met het Strafwetboek van 1810 ook de artikelen 414, 415 en 416 Sw.

Ze stelden zich niet echt vragen over de ongrondwettigheid dat daaruit zou kunnen voortvloeien.  Omdat men meer bezig was
met politieke vrijheden.


2. BEPERKTE ERKENNING VAN DE VAKBONDSVRIJHEID

Dat veranderde later een beetje. Art. 412- 420 werd opgeheven door de wet van 31 mei 1866. Werknemers mochten zich
verenigen.
