SJD1501-24-S1-92T ASSESSMENT 3

1. Criminal cases refer to matters involving offenses or law
infringements against the state. These can be categorized as criminal
cases happening when the government files a charge to file a reason
or need for court to punish a person or a group of people labelled as
defendant for committing a crime. Should the government find the
defendant guilty ‘beyond reasonable doubt’ the defendants will have to
serve a jail or prison sentence.
Civil cases relate to matters involving offenses or law infringements
against individuals, companies, or organizations. These disputes are
categorized as cases, where the state prosecutes the defendant. Civil
litigation involves two private parties in dispute over a legal wrong done
one against another and or between each other. When escalated to
legal dispute in court, the court must resolve the dispute between them.

2. Cases | Jurisdiction
2.1 A civil case handled by the High Court.
2.2 A civil case handled by the Magistrates Court.
2.3 A criminal case handled by the Regional Magistrates Court.
2.4 A criminal case handled by the District Magistrates Court.
2.5 A criminal case handled by Childrens Court.

3. The Constitutional Court is the highest court in the South Africa
when it comes to the interpretation, protection, and enforcement of the
Constitution of the Republic. It deals exclusively with constitutional
matters that are related and or identified with cases which raise
questions about the application or interpretation of the Constitution.
The Supreme Court of Appeal, formerly known as the Appellate
Division, is situated in the City of Bloemfontein and is the highest court
in respect of all other matters. It can hear and decide on an appeal
against or for any decision of a High Court in South Africa.
