Unit 1 – M3 - Explain ways of funding advice and representation.(M3)
Introduction
In this assignment I’m going to illustrate the different ways that Legal Advice and representation can be
funded in civil and criminal matters. Moreover I have demonstrated the legal advice procedure which
solicitors offer to their clients in order to familiarise them with the process and what they need to do in
order to have a better chance to be successful. Furthermore legal advice and representation can be
funded thorough governmental and non-governmental organisations and it is extremely crucial to
distinguish different methods in which they can be funded as Criminal cases require more financial
support as they typically need representation, however the legal funding is available for those who
cannot pay for their solicitors or legal representative especially in criminal cases as people are protected
to have a fair trial in which they acquire some advice and representation at the court. Moreover there
are four scenarios that I’m going to analyse in order to demonstrate the distinction between each
example and the ways that they can be funded. Moreover I’m going to evaluate the effectiveness of the
way in which the government funds the civil and criminal cases as well as demonstrating the
weaknesses and strengths of legal advice and representation within England and Wales in my
conclusion.
Value of payments made for cases completed in April 2013 to June 2016, by legal aid scheme
This diagram demonstrate the distinction of legal expenditure between civil and criminal cases in 2013
to 2016 in which has been reduced to £434m compare to the last year with 2 per cent. More
importantly this diagram illustrate the reduction of expenditure of civil legal aid in which has been
degraded more than criminal legal aid expenditure since 2013 due to the government’s cuts of legal aid
in civil matters as well as demonstrating that the workload, fees had been decreased.
