Kaiser is a rock driller at a mining company in Richards Bay. He was hit by a rock
at a mine shaft and lost the use of his left arm. Kaiser has made a claim for his
injuries under the COIDA. He wants to know from you whether he can also claim
compensation under the Occupational Diseases in Mines and Works Act 78 of
1973 (ODIMWA). Advise Kaiser with reference to relevant case law. (10)
Compensation under ODIMWA
Kaiser, as a rock driller who was injured at work, has already made a claim for
compensation under the Compensation for Occupational Injuries and Diseases Act
(COIDA). Now he wants to know if he can also claim compensation under the
Occupational Diseases in Mines and Works Act (ODIMWA).
ODIMWA is a specific legislation that provides compensation for occupational diseases
contracted by mine workers. It covers diseases such as silicosis, tuberculosis, and other
respiratory conditions that are directly related to working in mines.
In Kaiser's case, he suffered an injury from being hit by a rock, which resulted in the
loss of use of his left arm. This is not an occupational disease covered by ODIMWA, but
rather an injury covered by COIDA.
According to relevant case law, the South African courts have consistently held that
ODIMWA only applies to occupational diseases and not to injuries. In the case of
Chamber of Mines of South Africa v Mankayi, the Constitutional Court confirmed that
ODIMWA does not cover injuries, but only diseases.


Therefore, Kaiser cannot claim compensation under ODIMWA for his injury. His claim
for compensation should continue under COIDA, which covers workplace injuries.
