Facts of the case
The respondent Mr Nickolaus Ludick Fouché (Fouché), a mining consultant, gave a written mandate
to the appellant Global & Local Investments Advisors (Pty) Ltd (“Global”)4 in November 2015, to act as
his agent and invest money with a bank on his behalf. The money was to be deposited in a Corporate
Cash Manager (CCM) account in Fouché's name.5
