DEINSTITUTIONALIZATION, DIVERSION, DUE PROCESS AND
DECRIMINALIZATION

My support for deinstitutionalization, diversion, due process, and
decriminalization will be discussed in the paragraphs that follow.

I concur that the four Ds should serve as the foundation for a juvenile justice
system because:

De-institutionalisation

Children should not be institutionalized because children are highly
impressionable and can easily fall into the wrong crowd such as joining prison
gangs and being exposed to dangerous criminals. Therefore, a setting
centred on the community is more suited for young offenders as this can
properly mould them into functioning members of the community and aid
them with the support they so desperately seek.

Diversion

To preserve their wellbeing, manner of thinking and outlook on life, juvenile
criminals should be housed in a communal environment. By doing so, juvenile
criminals will realize that their negative actions do have consequences, and
this will help them identify issues with which they are internally and
externally facing. Setting up in the community is encouraged as they will be
housed in an environment that they are familiar with and surrounded by
friends and family, this will also help prevent any thoughts of escape,
loneliness, negative thoughts, aiding in an easier reform process.

Due Process

It is important to oversee juvenile offenders properly and in accordance with
their age. Regardless of the crime, juvenile offenders should get milder
sentences than adults in the legal system and should not be housed in the
same institution as adults. This will safeguard juvenile offenders from
predators and criminals that will want to further exploit them. Juvenile
criminals should be given treatment and sentences based on their age,
mental state, and capacity. They are still children and deserve the basic
human rights that every other child around them receives.
