Health And Safety At Work

Aims

In this report I will be researching, describing, explaining and summarising the health and safety
management, hazards, health and safety legislation in relation to the organisations (NewVic and
Chemoxy). The report will include aspects of hazards, health and safety measures used, how
successful the organisations are at achieving the highest standards of health and safety and
lastly how the measures taken comply with the organisation’s legislations.

Introduction

This report will evaluate NewVic and Chemoxy, the main activities, the hazards as well as the
health and safety measures they take in order to comply with their legislation, the PPE
(Personal Protective Equipment) provided by the organisations. Also, I will be discussing the
Health and Safety at Work Act, RIDDOR, COSHH, COMAH and CLEAPSS.
Moreover, this report will be used to successfully compare the health and safety measures
taken in relation to the legislation at both organisations. The mentioned laws are the main laws
that protect both workers and employers at work. These laws and regulations are there to
maintain high standards and levels of safety as well as maintaining the overall conditions of the
machinery, equipment and one’s health.

The Health and Safety at Work Act was first introduced in 1974. The legislation is to protect both
the employees and the employers at their workplace. It is there to remind the employees to use
the machinery with care and not harm themselves and others while using the machinery or
equipment, it also states that employees must cooperate with their employers during training,
wearing PPE and they must follow health and safety policies at all times. While the Health and
Safety at Work Act instructs employers to provide the necessary training, equipment and
personal protective equipment during the employee's shift. It is also important to note that under
the Act, employers must have an up to date training, health and safety policy, must maintain
and provide a safe working environment for their employees. Lastly, the Act says that there
must be a number of First Aid kits in case of an emergency. (2.)

Next, the law ‘RIDDOR’ stands for ‘Report of Injuries, Diseases and Dangerous Occurrences’.
Simply put the employer must keep a record of all the injuries and incidents that occur during
shifts. If the reported incident falls under the list (please see screenshot below), the employer
must report it to HSE - Health and Safety Executive.

Under the RIDDOR regulation, employees should comply with the following; keep others and
themselves out of danger, follow general health and safety policy and take care of themselves
and others at the workplace. The Health and Safety Executive is there to investigate reported
accidents and help employers to take action so that the incidents do not happen again in the
future.

COSHH, the ‘Control of Substances Hazardous to Health regulation was first created in 2002.
The substances that are thought to be hazardous to health are; chemicals, paints, fumes,
biological agents and dust. However, COSHH does not mention anything about asbestos, lead
radioactive materials. Workplaces that have COSHH as a part for the health and safety of their
employees and employers, should consider a limit of exposure, ‘Workplace Exposure Limit’, this
way there is a limited time at which the employees can work around the substances/ materials.
Employers should consider any materials or substances used at the workplace that are
potentially carcinogenic/ can cause asthma/ damage to genetic material. (4.)

Next, the Control of Major Accident Hazards, also known as COMAH, is a legislation to ensure
"Take all necessary measures to prevent major accidents involving dangerous substances. Limit
the consequences to people and the environment of any major accidents which do occur.” The
legislation came into force in 2015, which replaced COMAH 1999. This legislation applies to
chemical industries, nuclear sites, or where dangerous chemicals are kept.
