Involuntary Manslaughter
● Where you have killed someone through accident or mistake

● Indictable offence

● Maximum sentence: discretionary life- the Judge can give a life sentence but can give anything below (likely a
custodial sentence because D has taken a life)

Two different types of involuntary manslaughter:

● Unlawful Act Manslaughter (UAM)
● Gross negligence manslaughter (GNM)

Made up of four parts (the test)

D must have:
● unlawful act (AR)
● act is dangerous (objective test) (AR)
● act causes death (AR)- causation
● D had mens rea for unlawful act (MR)

Unlawful act (AR)
● There has to be an unlawful act of some kind

R V Lamb (1967) (Must be an unlawful act)- Kid killed other by accidentally shooting him
○ Two kids were playing with a gun
○ One accidentally killed as shot the other but didn't know the gun was loaded
○ Couldn't be guilty of involuntary manslaughter because it was an accident
