Read the case incidences below carefully and answer the three (3) questions that follow.

QUESTION 1

Lesego Shelter, a 10-year-old girl, was driving home with her parents after their summer holidays at the
coast. About 100 kilometres from their home a truck made an illegal U-turn and their vehicle collided with
the truck. Lesego was in a critical condition but recovered to the extent that she was moved from the ICU
ward to a general ward. Lesego suffers from speech problems and has difficulty understanding basic
concepts.

Lesego’s father filed a case against the Road Accident Fund. The attorney who acted on behalf of Lesego
referred her to an educational psychologist for an evaluation. With the aid of examples, demonstrate the
role of the educational psychologist in Lesego’s personal injury claims.

Glen Smit, an 87-year-old widower, met a 20-year-old lady at a charity function. He enjoyed her company
and started to spend his money on expensive jewellery and overseas trips. His children were against the
relationship and filed an application to the High Court to appoint a curator to handle Glen’s affairs.

With reference to the above, compare the different types of curators by explaining which type of curator
would most likely be appointed to handle Glen’s affairs and also discuss the role of the psychologist in
appointing a curator.

QUESTION 3

Zanele, a 10-year-old IsiZulu-speaking girl, was involved in a motor vehicle accident in which a speeding
motor vehicle hit her while she was standing on the pavement. She sustained a severe brain injury and an
arm fracture. She was unconscious for three weeks and in hospital for two months, separated from her
parents. Two years have passed since the accident. At the time of the accident she was in Grade 2 and
was an average learner. She is now struggling at school and has problems expressing herself verbally. She
has become clumsy and finds it difficult to carry heavy objects. Socially, she prefers to play with younger
children, and children of her own age tease her about her physical problems and her failure at school. Her
teachers have noted that she is easily distracted, has a poor memory, struggles to concentrate and has
difficulty interpreting questions and textbooks. She has temper outbursts and isolates herself from others.
Her parents have instituted a claim against the Road Accident Fund. You are the lawyer they have
approached to handle their claim. With the aid of practical examples, explain the role of the following in
Zanele’s case:
