Dit opgaven-antwoordformulier bevat inclusief het voorblad 23 pagina’s. Controleer of het
formulier compleet is. Zo niet, waarschuw dan een surveillant.
Dit tentamen bestaat uit twee delen. Deel I bevat 25 meerkeuzevragen. Het cijfer voor deel I
telt voor 40% mee in het eindcijfer. Voor het beantwoorden van de meerkeuzevragen dient u
een apart formulier te gebruiken. Vul op het meerkeuze-antwoordformulier meteen uw
naam, studentnummer en de versie (A of B) die u maakt in. Het antwoordformulier mag
met pen of potlood worden ingevuld, maar niet met de kleur rood. Eventuele vergissingen met
pen kunt u door middel van het duidelijk doorhalen van het foute antwoord herstellen.
Deel II bevat 2 open vragen, onderverdeeld in subvragen. Per vraag is telkens aangegeven
hoeveel punten daarvoor kunnen worden behaald. Het cijfer voor deel II telt voor 60% mee in
het eindcijfer. Wees bij de beantwoording beknopt en kernachtig, maar motiveer al uw
antwoorden. Verwijs zo mogelijk naar relevante artikelen en naar toepasselijke jurisprudentie.
Blijf bij de beantwoording zoveel mogelijk binnen de daarvoor aangegeven ruimte. Ga zo
nodig verder met schrijven op de achterkant van het formulier en geef dit dan duidelijk aan.
Tijdens het tentamen mag u slechts gebruik maken van een niet-geannoteerde
wetgevingseditie (Kluwer dan wel Vermande; Euro-pocket) en een (niet-geannoteerd)
woordenboek Engels-Nederlands. Relevante bepalingen van Richtlijn 2004/38 zijn aan het
tentamen gehecht.
Wij wijzen u nadrukkelijk op de sancties die bij fraude kunnen worden opgelegd: niet alleen
wordt voor het tentamen het cijfer 0 toegekend, ook kunt u van deelname aan tentamens
worden uitgesloten. Het meegebrachte materiaal kan tijdens het tentamen door surveillanten
steekproefsgewijs worden onderzocht.
Uw collegekaart wordt gecontroleerd. Leg deze s.v.p. op de hoek van uw tafel, zodat de
surveillant u niet hoeft te storen bij de controle.
Toiletbezoek is toegestaan na toestemming van een surveillant. Het laatste halfuur is dit niet
meer mogelijk. Er kan steeds slechts één deelnemer tegelijk de zaal verlaten voor
toiletbezoek.
Vergeet niet op de voorpagina en op elk antwoordvel uw naam en studentnummer in te vullen.

1. The law of Member State X prohibits judges from introducing new legal arguments if
these have not been raised by the parties to a case. In a dispute before Judge Dredd an
EU directive is clearly relevant, but neither party mentions it. Judge Dredd is trying to
