Unit 1: An introduction to the South African criminal justice
system
Provide an overview of the South African criminal justice system (pg. 67)
• The SA criminal justice system (CJS)
o managed by the Department of Justice and Constitutional
Development (DoJ&CD).
• CJS decides on the types of sentencing + deals with both victim and offenders
+ aims to protect the rights of all.
• In 1994 the Justice, Crime Prevention and Security (JCPS) cluster was
established.
• JCPS consists of SAPS, DoJ&CD (including NPA), DCS, DHA, Defence and
Military Veterans, SSA.
• Core of the CJS = SAPS (police), DoJ&CD (courts) and DCS (corrections).
o Brief explanation of the core departments:
▪ SAPS = investigate and prevent criminal acts and arrest
suspects.
▪ DoJ&CD = management of the courts system with the NPA
focusing on the prosecution of suspects.
▪ DCS = incarcerates sentenced offenders in correctional centres
(IN THIS MODULE WE DON’T REFER TO PRISONS OR
CRIMINALS) and aims toward the rehabilitation of all inmates.
▪ These core departments for KRM 120=law enforcement
(SAPS, Metro Police and IPID); the SA court structure
and sentence options; and corrections.
Give an exposition of the functioning of the South African criminal justice
system (refer to diagram on pg 68)
