️ Master Client Conferences and Witness Handling without losing easy marks under assessment conditions. The Oral Skills module on the BPP Bar Training Course (BTC) covers two critical barrister competencies: Conference Skills (advising clients, establishing case theory, managing expectations) and Witness Handling (Examination-in-Chief and Cross-Examination). You aren't just marked on your legal knowledge - you are assessed on structure, rapport, questioning technique, time management, and adapting to vulnerable witnesses. Why these notes will turn your revision around: Distinction-Grade Standard: Aligned strictly with BPP’s Oral Skills marking schemes and BSB professional standards. Plug-and-Play Conference Agendas: Step-by-step structures for introducing the conference, managing time, taking instructions, delivering realistic risk/quantum advice, and closing professionally. Cross-Examination Frameworks: Clear techniques for controlling hostile witnesses, leading questions, pinning down inconsistent statements, and avoiding improper cross-examination trapdoors. Examination-in-Chief Blueprints: Frameworks for non-leading questioning, taking a witness through their statement, and laying foundations cleanly. Handling Special Measures & Ethics: Key reminders on vulnerable witness questioning rules, managing difficult clients, and maintaining duty to the court. Stop worrying about freeze-ups or losing control of witnesses. Download these notes, master the structures, and walk into your assessment ready for a Distinction.

D (Mr Anderson) gave sufficient space to Tom
It isn’t 100% clear if tom did clap or not.

Mr Anderson just got out of the car to ask what the issue was. – he
wasn’t angry

Tom punched only once, with force.
Mr Anderson then punched Tom to defend himself.

Mr Anderson accepts injuring Tom.
But not putting him in a headlock.
He was just trying to get him off him and get away.
He DID NOT make threats to other women.

Mr Anderson got to his car asap.
He didn’t do anything in regards to the incident as he just wanted to get
away.

Tom saw Mr Anderson pull the wing mirror off the car and was scared he
was trying to get in the car.

There was no revving the engine, he did not swerve. He doesn’t believe
there was even a collision.

James is willing to attend court and give evidence as a defence witness.
Scared bcoz he doesn’t want to face fake allegations.

Anderson
He wants to plead not guilty. He doesn’t want the credit.
Wants to say not guilty to both offences even in CC.

His trial is in crown court
He is still on unconditional bail
As he is on bail he needs to attend every hearing. Otherwise contempt of
court occurs.

Doctor Report:
On systematic examination in the department, he was alert with a Glasgow Coma Scale of
15, he had bruising and swelling to the left side of his face with a 2 cm laceration, forehead
and around his left eye. He complained of pain across his right shoulder and arm, right side
of his abdomen, right thigh, right leg just below his knee.

He had a CT scan of head to pelvis. This found a moderate subcutaneous left sided
periorbital haematoma. The X Rays of his femur, ankle and leg did not show any bony injury.

,He required wounds to be cleaned and dressed. The laceration was closed with glue. He
received head injury advice which included that he should not drive at work until fully
recovered from his head injury. He was prescribed analgesia.

James Taylor Statement:
- ANDERSON slowed his vehicle down in a bid to let the vehicle carry
out its manoeuvre.
- sat there clapping with both of his hands as he moved off past us in
the opposite direction. (DANGEROUS!)
- He was staring at us as he did so.
- ANDERSON stopping the car
- the other car also stopped and we were about 20 feet away from each other.
- I do not know who got out first. (BOTH PEOPLE DK WHO CAME OUT
FIRST)

AFTER THEY GOT OUT OF CAR:
- The man had been stood next to his car door when ANDERSON approached him. I
heard ANDERSON say something along the lines of, “WHAT IS YOUR PROBLEM? I
GAVE WAY DIDN’T I?”
- but he was laughing at ANDERSON and appeared to be antagonising
him.
- The men did not appear to be shouting at one another,
- Could tell it was going to become heated
- He said IF MY MUM WASN’T HERE!” Which I took to mean that he
would have attacked ANDERSON but for the presence of his mother.

- I then saw the man take a step forwards towards ANDERSON (he
took the first step closer to Anderson)
- I've then seen the man barge past the female
- and he went for ANDERSON.
- was both of them were fighting

- Both ANDERSON and the male got hold of each other
- Both were throwing punches at each other
- the man (tom) had a black eye or a bust nose
- I AM GOING TO KILL YOU” and he walked towards us. By this time, I
had gotten out of the car

- Mother shouted: YOU ARE GOING TO GET IT TOO
- I then saw the man walking towards the front of ANDERSON'S vehicle. He started
ripping at the windscreen wipers which caused them to bend. He was staring intently
at the car and I remember thinking that he was crazy. The man lent over the front of
the car so he could reach the wipers. I remember ANDERSON shouting, “GET OFF
MY CAR” and he was shaking.

, - The man then moved to the driver’s side of the vehicle and pulled at
the wing mirror. It did not come off.
- I don't recall any impact between ANDERSON's car and the man.
- I noticed that ANDERSON had injuries and his own joggers were ripped.

- The incident literally lasted a few minutes but it was very scary

- I feel that the man who drove the Skoda started the altercation and ANDERSON
simply acted in self defence.

Visibility was good and there were no obstructions = so James would be a good witness to
testify.

Next statement – James Taylor
- The two vehicles were able to pass each other without issue yet the complainant
insisted on making a big deal out of what had gone before it.
- On reflection, I now think that the complainant got out of his car first and then my
friend Craig followed.
- complainant brushed past his mother and took a swing at Craig.
- Craig acted in self-defence in throwing a punch back in retaliation.

Tom’s witness statement:
- Nothing was said at that point. But, as I drove past him, I
looked at him and clapped as if to say ‘yes, well done.’
-
- Why did you do that?
-
- Because I was irritated to be honest. I had my child in the
car and the aggressive driving from the man in the Range
Rover was just completely unnecessary. It was my way of
venting I suppose.
-
- Did the driver of the Range Rover say anything?
-
- Not at that point, no. But, as he drove away, I saw him
stick his head out of the window. I am sure he was
shouting something then. I think he was swearing at me.
-
- Was he still driving at that point?
-
- He was but then he slammed his brakes on and stopped
his car. He jumped straight out and stormed towards my
car.

, = what aggression. U don’t even know what he said. He also stopped. What more did u
want him to do.

- Nothing was said at that point. But, as I drove past him, I looked at him and
clapped as if to say ‘yes, well done.’
-
= that’s aggressive. Provocation.

- To see what on earth was going on. He clearly had an issue with me and I had
no idea what that issue was. On reflection, I wish I'd just driven away.

= clearly had an issue? Who said? Again.. u don’t even know what he said. Why did u get
out of the car, if u knew he was angry understandbily and wanted a fight?

He did. He asked me why I had given him a sarcastic applause. I just said to him that
he didn't give me any space which was true.
= he did give space. There was ample space. He was carrying out a turn so didn’t see u, he
was focused on his turn. When he finally found out he stopped for u. to let u go. If he was so
aggressive he could’ve just continued driving as u were obstructing his side of the road no?
= there was no need for u to clap

Anderson kept saying ‘what you gonna do about it? What are you going to do about
it?’
= he didn’t he just said what is your issue, I gave way. Which is facts. Him and his mother
were the one who got aggressive with him. By saying ‘if my mother wasn’t here’.

I think he wanted a fight. He was pumped for it. I had no intention of fighting when my
child was in the back of the car.
= how can someone be pumped for a fight if they just say whats wrong? He clearly stopped.
He wouldn’t have stopped otherwise.

I turned around as if to get back into the car. I put my hand on my mum’s back and
guided her back towards the vehicle. At that point, I felt the man grabbed my left
shoulder, he spun me around and then he punched me to the eye. There was blood
everywhere and I had to have it glued at the hospital.

= If u knew he wanted a fight why would u turn your back on him
