FOR3702 ASSIGNMENT 2 2026
DUE SEPTEMBER 2026
Question 1
2.1 Did Mr X commit any crime or not? Motivate your answer. (4)
Yes, Mr X committed the crime of armed robbery.
He entered ZB Bank, observed a large amount of cash in Ms Consumption’s drawer,
produced a pistol, pointed it at her and demanded that the cash be placed in a green
plastic bag and handed to him. He then left the bank with the bag of cash. This
constitutes the unlawful and intentional appropriation of property by means of violence
or the threat of violence (the pointed firearm), which meets the definitional elements of
robbery under South African criminal law (Horne, Zinn & Dintwe 2nd ed, Chapter 1).
The later use of the proceeds (purchase of a house and vehicle and the deposit of the
balance) does not erase the primary offence.
, 2.2 Demonstrate how you would source information that will assist in solving this
crime.
Information would be sourced systematically from both open and closed sources,
following the modern proactive investigative cycle (Horne et al., Chapter 1: 1.6.4).
Crime-scene / bank sources: Interview Ms Consumption and other witnesses; seize
CCTV footage, access-control logs and the bank’s occurrence book; document the
open-plan layout and drop safes.
Official databases (SAPS investigators): Criminal Record Centre (CRC) for possible
prior records; Forensic Science Laboratory for ballistic or fingerprint evidence; vehicle
and Deeds Office registers linked to the Ferrari and the house.
Open-source intelligence (OSINT): Social-media profiles, company registration
records, Deeds Office records for the R2 million house, vehicle registration details
and public information on Tesla Bank.
Financial sources: Court orders or section 205 subpoenas for Tesla Bank statements
and source-of-funds documentation; liaison with the Financial Intelligence Centre
(FIC).
Surveillance: Mobile or static surveillance on Mr X, the house and the vehicle to
establish lifestyle and associates (Thenga, Learning unit 1: 1.8.2).
Informant and community sources: Local informants who may know of the sudden
acquisition of high-value assets.
These steps allow the investigator to move from crime-threat analysis to profiling and
case-building (Horne et al., Chapter 1).
