The Foundation for Professional Development Organisation
The objective of this organisation is to improve service provision and community awareness of services for
survivors of sexual assault in South Africa, which struggles with one of the highest rates of gender-based
violence in the world.
The objective of this organisation is to improve service provision and community awareness of services for
survivors of sexual assault in South Africa, which struggles with one of the highest rates of gender-based
violence in the world. This organisation provides a comprehensive portfolio of services to survivors of GBV,
including emergency medical care, psychosocial counselling, post-exposure prophylaxis (PEP), HIV testing and
counselling, and assistance with case reporting and court preparation in an integrated and victim-friendly
manner. The FPD model seeks to streamline the care process for gender-based violence survivors by
establishing effective linkages between various service providers and government stakeholders, and to
improve legal services by reducing time-to-court and increasing the conviction rate.

, Introduction:
Gender Based Violence human rights violation is violence against women as a symptom of unequal power
relations and a mechanism to control women. The primary focus of the Gender Based Violence law is to
regulate the measures needed to effectively achieve the principle of gender equality, to repress and make
perpetrators accountable, and guarantee support to victims. It does not limit violence to the context of marital
relationships: it considers isolated or recurrent violence, occurring within the family or within any intimate
relationship, present or prior, irrespective of cohabitation. It considers physical, psychological, sexual, moral,
financial, as well as sexual harassment. The reason why I have chosen this specific human right violation is that
it been a huge problem in our country and communities for a very long time, with cases rising none stop and
at the moment it has reached its peak in the number of cases in my community and I think it’s time it comes to
an end by raising this issue and informing people in my community about it.
Body of Report:
The Criminal and Related Matters Legislation
This law comes in response to public outcry against accused offenders being easily granted bail, and
perpetrators only having to serve minimum sentences for very serious crimes. This law also recognises sexual
intimidation as an official offence, which it had not done before. This means that if you are threatened by
someone’s behavior towards you, verbally or otherwise, you can report it and seek legal action.
Extent of Protection
With this law, those accused of gender-based violence could only be granted bail under exceptional
circumstances. If these circumstances were accepted, the court would then have to consider a number of
things before granting them bail, including whether or not the survivor would feel safe with the decision. The
law also increases the reporting duty of those who suspect that a child is the victim of a sexual offence. It’s not
clear yet who this duty is extended to, but it should be clarified as the law is finalized.
The Domestic Violence Legislation
This law is to regulate the measures needed to effectively achieve the principle of gender equality, to repress
and make perpetrators accountable, and guarantee support to victims. This law is mostly to protect woman
from violence on the home front.
Extent of Protection
This law’s protects people from domestic violence and it includes victims of assault in engaged to be married,
those who are dating, those in customary relationships, and those in actual or perceived romantic, intimate, or
sexual relationships of any duration. This means that if you are hurt by someone who you’ve been dating, you
would be able to make a case against them under the Domestic Violence Act. This extended definition would
also include older citizens who have been abused by family members. The protection order would also be
added to a central digital depository that houses other orders and cases made against the same person.
