LCP4807 Assignment 2 (COMPLETE ANSWERS) Semester 2 2026 - DUE 8 September 2026; 100% Correct solutions and explanations. ASSIGNMENT 02 Submission Due Date: Tuesday, 8 September 2026, 5:00 PM The Republic of Masaala is a small country in Southeastern Africa, with a population of just over 3 million. It is one of the poorest countries in the world, with 70% of the residents living on less than $3 per day. Masala is a culturally rich country with a patriarchal society where gender norms are set with an understanding of the sociocultural expectations of both women and men. Masaala has a constitution that includes a Bill of Rights, which is the country's supreme law. It has ratified the following major United Nations (UN) human rights instruments: the Universal Declaration of Human Rights (UDHR) and the International Covenant on Economic, Social and Cultural Rights (ICESCR) (and its Protocol). Masaala has also ratified various African instruments including, the African Charter on Human and Peoples’ Rights; the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Women in Africa, and the Protocol to the African Charter on the Establishment of an African Court on Human and Peoples’ Rights but has not made a special declaration in terms of article 34(6). Mr Nhamo, his wife Tambudzai, and their two children (both girls), between the ages of ten and fifteen (all girls), are citizens of Masaala. LEGAL OPINION FOR THE PAN-AFRIKAN HUMAN RIGHTS
ORGANIZATION (PAHRO)

Introduction

This legal opinion examines whether the Republic of Masaala has violated its
regional and international human rights obligations concerning the people of
Esihlahleni village. The opinion focuses on the procedural requirements for
bringing a communication before the African Commission on Human and
Peoples' Rights (African Commission), the substantive human rights violations
arising from the facts, and the remedies that may be granted. It also considers
the interaction between international human rights law and the African regional
human rights system.

The facts indicate that despite exhausting all domestic remedies over a period
exceeding ten years, the government of Masaala has failed to provide even the
most basic services such as clean drinking water, healthcare, education, roads
and adequate housing. The Constitutional Court accepted the government's
argument that budgetary constraints justified its failure to fulfil these
obligations. PAHRO therefore seeks advice regarding the possibility of bringing
a communication before the African Commission on Human and Peoples'
Rights.

Applicable Legal Framework

The Republic of Masaala has ratified several important international and
regional human rights instruments. These include:

• Universal Declaration of Human Rights (UDHR)
• International Covenant on Economic, Social and Cultural Rights
(ICESCR)
• Optional Protocol to the ICESCR
• African Charter on Human and Peoples' Rights
