Discuss the burden and standard of proof as well as the proof of
previous convictions during the course of a bail application. (15)
Burden and standard of proof
The standard of proof required from an accused where he bears the burden
for ss 60(11) (a) or 60(11) (b) is balance of probability.
Question 2
An inexperienced prosecutor in the lower court formulates a murder
charge as follows: ‘The accused is guilty of a crime in that the accused
did intentionally and unlawfully cause the death of a human being’.
In terms of section 84(1), and notwithstanding sections 86(1) and 88, is
the charge formulated in sufficient detail? (15)
Section 84- Essentials of charge
Charge sheet shall set forth the relevant offence in such manner
and with such particulars as to time, place, person against whom
and what property (if any) in respect of which offence is alleged to
be committed as may be reasonably….
