A. De formele bronnen van het internationaal recht
=> Er is geen centrale wetgever.
=> Wie is betrokken en hoe wordt ermee ingestemd?
=> Waar vindt men de vindsplaatsen v.d. afgesproken rechtsregels terug?

!!! Er is geen instrument met alle internationale bronnen.
=> Art. 38 legt uit welke bronnen de rechter v.h. internationale gerechtshof zal gebruiken om te oordelen.
!!! Ook al verouderd dus niet meer exhaustief: er zijn nog andere bronnen



B. Het statuut van het internationale gerechtshof
Het internationale gerechtshof
= Het hoogste juridische orgaan v.d. VN, opgericht met de VN, zetelend in Den Haag.

1e bevoegdheid
=> Geschillen tussen staten oplossen.

2e bevoegdheid
=> Advies verlenen aan organen v.d. VN.


Het statuut v.h. internationaal gerechtshof
= Het verdrag dat het functioneren v.h. internationaal gerechtshof regelt.

 Handvest v.d. VN = De VN functioneert overeenkomstig dit verdrag.
