Question 4

A similarity or difference is legally significant if it relates to:
Your Answer:
Issue:
What renders a similarity or difference between them legally significant when comparing cases?

Rule:
Georgetown Law’s Writing Center states that a similarity or difference is legally significant if it “relates to a
term in the governing rule of law or a principle implicated by the rule or its application in the case.”[1]
Syracuse Law also defines legally significant facts as those that, if altered, could change the outcome of
the court’s decision.[2]

Application:
The base for both analogizing and distinguishing precedent is in legally significant similarities and
differences. When two cases that have similar material facts about a rule element—such as the issue of
reasonableness in a negligence case—their similarity justifies the application of the same rule outcome.
On the contrary, if a difference affects whether a rule element is satisfied, such as whether a duty existed,
a significant difference applies as the basis for distinguishing the precedent. This concentration
guarantees the consistency in application to relevant facts that is necessary for the law, an essential
element of stare decisis and its subsequent application to proper fact-keeping.

Conclusion:
A similarity or difference is legally significant only if it is relevant to the law as it operates in a particular
case. By correlating factual comparisons with rule-based reasoning, courts and advocates maintain the
coherence of legal analysis and ensure that precedent properly serves the purpose of guiding judicial
decisions.
