Comprehensively structured RRLLB81 Assignment 3 PORTFOLIO (RESEARCH REPORT ANSWERS) Semester 1 2026 - DISTINCTION GUARANTEED. Prepared to a distinction standard with detailed and well-developed responses. .. The Concept of Self Executing Treaties A treaty can be described as self-executing treaty if it becomes directly enforceable as part of domestic law in a country upon ratification, this can happen without the treaty being formally implemented by the legislature. This means that the courts can apply the rules of the Downloaded by Pied Zulu () lOMoARcPSD| 60 treaty immediately to grant rights or impose obligations on individuals. The language of the treaty must make it clear that the treaty applies to domestic law without formal implementation. Assessing the South African Constitution, one wonders whether certain treaties can be applied in South African courts even without ratification. It could be argued that all human rights treaties are self-executing in South Africa and may not even require ratification, or this is not legally possible since every law must be properly implemented before it can be enforced. Abstract

This research examines the concept of self executing treaties within the framework
of South African constitutional law. A self executing treaty is generally understood as
an international agreement that becomes directly enforceable in domestic law
without the need for further legislative implementation. The study investigates
whether the South African Constitution allows treaties, particularly human rights
treaties, to be applied by domestic courts without formal incorporation through
national legislation. It analyses the constitutional provisions governing the status of
international law and considers the interpretation adopted by South African courts in
relevant cases such as President of the Republic of South Africa v Quagliani and
Claassen v Minister of Justice and Constitutional Development. The research also
draws on scholarly commentary and comparative perspectives to evaluate whether
international agreements may have direct domestic effect in South Africa. The study
concludes that while international law influences constitutional interpretation, treaties
generally require parliamentary approval and incorporation before they can be
directly enforced in domestic courts.
