Introduction

In South African law, testamentary capacity is a fundamental
requirement for the execution of a valid will. Legal capacity entails that
a person must be of sound mind, understand the nature and effect of the
testamentary act, and appreciate the consequences of their decisions. An
insane person generally lacks this capacity, and therefore cannot make a
valid will. However, the law recognises that insanity is not always
continuous and may be interrupted by periods of lucidity. During such a
lucid interval, an insane person may regain sufficient understanding to
execute a will that reflects their genuine intentions.

The issue of wills executed during lucid intervals raises complex legal
questions. Evidence establishing a lucid interval is inherently
retrospective and often contested by interested parties, particularly
where intestate succession may otherwise benefit certain heirs. Courts
have had to balance protecting vulnerable testators against ensuring that
their genuine intentions are honoured. This research paper examines the
legal principles governing testamentary capacity, analyses judicial
interpretation of lucid intervals, and evaluates the feasibility and fairness
of recognising such wills under South African law.
