There are several laws in the UK that deal with the gathering, keeping, reporting, and
sharing of data in childcare settings. Some of the most important are:
Data Protection Act of 2018: This act specifies the obligations of data controllers and
processors and regulates the processing, storing, and sharing of personal information,
including that of children.
The General Data Protection Regulation (GDPR) is a regulation of the European Union (EU)
that specifies guidelines for data protection and privacy, including how personal data should
be gathered, stored, and shared.
The Children Acts of 1989 and 2004: These laws establish the UK's legal foundation for the
protection and welfare of children. They describe how the courts, local government, and
other organisations involved in child welfare and protection carry out their respective roles
and mandates.
The Education (Pupil Information) (England) Regulations of 2005 These rules specify the
procedures for gathering, storing, and disclosing information about pupils at schools,
including their personal information and academic performance.
Early Years Foundation Stage Framework (EYFS): This framework outlines the
requirements that early years childcare providers must meet, including the need to maintain
records of children's growth and learning.
The Safeguarding Vulnerable Groups Act of 2006: The enhanced Disclosure and Barring
Service (DBS) checks are one of the requirements outlined in this act for people who work or
volunteer with children.
To ensure that children's privacy is protected and that their welfare and protection are given
priority, childcare facilities must abide by these laws.

My setting, St. Paul's Playschool, has various policies and procedures in place to record,
store, report, and share information in a safe and secure manner. Access to our designated
person's records is limited to authorised personnel, and they are kept up to date and
accurate. Paper and digital records are kept in secure locations, and there are detailed
procedures for reporting incidents and safety concerns. Before disclosing any information to
parents or other professionals, we obtain permission, and all staff members are instructed in
