(a) Applicable law

Thabo died intestate in 2025, therefore his estate devolves in terms of the
Intestate Succession Act 81 of 1987, read with the Recognition of Customary
Marriages Act 120 of 1998.

All valid customary marriages are recognised, and each surviving customary wife
is regarded as a “spouse” for purposes of intestate succession.
