The Role of Opposition Political Parties in Advancing and
Protecting Constitutional Democracy in South Africa

Introduction

South Africa’s transition from apartheid to constitutional democracy in
the early 1990s marked a profound political and legal transformation.
Leaders from sharply different political traditions most notably F.W. de
Klerk of the National Party, Nelson Mandela of the African National
Congress, and Mangosuthu Buthelezi of the Inkatha Freedom Party
played a central role in guiding the country towards a democratic order
founded on constitutional supremacy, the rule of law, and political
pluralism. This transition culminated in the adoption of the Constitution
of the Republic of South Africa, 1996, which entrenched democracy as a
foundational value of the state.

However, sustaining democracy is far more complex than achieving a
democratic transition. A functioning constitutional democracy requires
not only regular elections, but also strong institutions, respect for
constitutional norms, and a political culture in which all actors accept
the “rules of the game”. Section 1(d) of the Constitution affirms that
South Africa is founded on a system of democratic government based on
regular elections and a multi-party system, intended to ensure
accountability, responsiveness, and openness. Opposition political
parties therefore occupy a constitutionally significant role within South
Africa’s democratic framework.
