◉ Anatomical gift liability. Answer: A funeral director acting in good
faith is not liable in damages for injury resulting from acting or
attempting to act in accordance with sections 2108.01 to 2108.29 of
the Revised Code regarding an anatomical gift.


◉ What is an alternative container?. Answer: A receptacle, other
than a casket, in which a dead human body is transported to a
crematory facility and placed in the cremation chamber for
cremation.
- Is composed of readily combustible materials that are suitable for
cremation;
- May be closed in order to provide a complete covering for the dead
human body or body parts;
- Is resistant to leakage or spillage;
- Is sufficiently rigid to be handled readily;
- Provides protection for the health and safety of crematory
personnel


◉ Body Parts. Answer: Limbs or other portions of the anatomy that
are removed from a living person for medical purposes during
biopsy, treatment, or surgery. This also includes dead human bodies

,that have been donated to science for education, research, and any
parts of such a body that were removed for those purposes


◉ Antemortem cremation authorization. Answer: - Any person, or
their guardian, custodian, or personal rep, may serve as their own
authorizing agent antemortem
- Must be signed by 1 witness
- Original goes to authorized crematory, copy for authorizing agent
- This may be revoked at any time with written notice
- May be transferred at any time with written notice and the signing
of a new form
- A new 2006 provision states that at TOD, NOK may cancel, modify,
or make alternative arrangements
- Authorizor is encouraged to state preferences to the manner of
final disposition and arrangements set forth in the form be followed
- Nothing in this section applies to antemortem auths executed prior
to 1998 (not sure if this means a death occurred or just signed
ppw?)


◉ Conditions for cremation. Answer: (does not apply to body
donated to science)
- 24 hours have elapsed since death (unless virulent, communicable
disease then dept of health can rule to cremate or not)
- Crematory receives burial or burial-transit permit

, - Crematory receives cremation auths (crematory shall provide
blank forms)


◉ What must be included on a cremation authorization?. Answer: -
Deceased positively identified. Additionally, ID must be of remains,
photo or other visual image of remains. Auth. agent must sign photo.
Other methods of ID include coroner's office ID and images of
scars/tats/deformities.
- Name of individual who obtained burial-transit permit
- Name of authorizing agent, relationship, that they in fact have the
right to authorize the cremation, they know of no other person with
superior right, and if they do, that reasonable efforts have been
made to contact said person by authorizing agent and have been
unable to do so, and finally, that they have no reason to believe this
person would object
- If auth. agent knows of any mechanical/radioactive device/implant
posing a hazard to personnel
- Indication that crematory is to cremate casket/alt con the dcdnt
was delivered/accepted in
- If crematory is authed to simultaneously cremated dcd in same
chamber with 1 or more dcd who were related by consanguinity or
within the last year were married under common law/cohabitated
(but under no other circumstances)
- If anyone is authed to be present in holding facility or cremation
room prior to, during, or during removal
