P4 descriptions of the role of lay people in criminal
case
Lay People
Lay People must demonstrate six qualities and one
is to be a good character, have personal integrity.
Integrity means to be honest at all times which
would be useful to be as one of your ethics. In
addition, lay people must be understanding and
must have good communication skills. This is
because they must be able to understand
documents, identify facts and be able to
communicate effectively in and out of Court. It is
important for lay people to be able to understand
documents as they me be presented with a
documentation within the court and they may not be
able to identify what they are being presented with,
this can slow down the court case as they may
need time to carefully read the document and may
possibly need someone to effectively explain the
importance and context on the documentation.
I’m addition, lay people must have social
awareness and respect for all individuals who are
from different background(s) and may have had a
different upbringing from themselves. Another key
characteristic is being able to understand the
community, this so that when cases are being
presented within the community they will be able to
understand the area such as where the local parks
are or path ways/ sidewalks. Maturity is a key
characteristic every individual should ideally have,

, especially lay individuals as they may be brought
with cases and their reaction to certain statements
and arguments may offend an individual possibly
the defendant which would waste time within the
Court and the defendant may be punished for
speaking out of line for reacting to what someone
had said/done in regards to their case. Being fair
and polite may allow people to feel as though they
are able to say their peace (if they’re able to)
without feeling uncomfortable and feeling judged.
Thinking logically as a lay person by weighing up
arguments may help decision making less difficult
as they have heard from both parties and
concluded, this is called sound judgement. Those
who is a lay individual must be committed to this
role as well as reliable. This is important because if
a lay person was not committed then they wouldn’t
be demonstrating that they are serious about this
role and they could possibly be fired and another
individual may take their place, same goes for a lay
person not be reliable. If a lay individual is
continuously calling in sick without validity, they can
possibly be dismissed also.
P5 Outlines the role of variety of judges and
lawyers in civil and criminal cases
Judges
There are a variety of judges and the role of a judge
is to remain order within a court room, listen to
arguments from both parties and sentence those
