The question arises whether a government's legal adviser’s views may differ from the positions of authoritative sources. Ultimately, this paper argues that while legal advisers may offer interpretations that diverge from the ICRC or international courts, such divergence must be carefully justified.

The statement by Sir Michael Wood, then the chief Legal Adviser to the UK Foreign and Commonwealth Office, argued that the Security Council (SC), by adopting Resolution 1441, had not revived the authorisation to use force of Resolution 678.
