1.1 The Convention on the Elimination of All Forms of Discrimination against Woman
(CEDAW)
1. Introduction
Generally, CEDAW was established in the year 1979 but came into operation in the
year 1981 by the General Assembly, its main aim is to eliminate all forms of
discrimination against women and children to make sure that women are awarded
equal opportunities and are treated the same with men, 1 According to article 2 of the
CEDAW, it is the state members to this convention’s responsibility to make sure that
discrimination against women in every possible way has to be eliminated, this will
happen when state members firstly embodies the principle of equality of men and
women in their respective national constitutions or other legislations to ensure by and
other appropriate measures the practical realization of this principle, secondly adopt
necessary legislative measures and sanctions where required that forbids all forms of
discriminations against women, thirdly establish legal protection protecting the rights
of women equally as men and to sure that effective protection for women against all
forms of discrimination has been put in place by the correct capable national tribunals
and other public institutions, fourthly to abstain from any practices that will lead to any
form of discrimination against women and make sure that all public authorities and
institutions act in accordance with this obligation, fifth is taking all the necessary
measures that need to be taken to eliminate all forms of discrimination against women
by any person, private or public organisation or enterprise, sixth also take the
necessary measures together with legislation to modify or abolish any laws,
regulations, customs and practices that discriminate against women and lastly seventh
is to repeal all national penal provisions that contribute towards any form of
discrimination against women. 2
