A special entry is a formal record placed on the trial proceedings highlighting that an irregularity or illegality has occurred, which might have had a material effect on the fairness of the trial (Joubert, 2019). The purpose of this mechanism is to ensure that justice is not undermined by procedural defects that could prejudice the accused. An irregularity generally refers to a deviation from prescribed legal procedures or trial rules. This could include the wrongful admission of inadmissible evidence, denial of the accused’s right to cross-examine witnesses, or the presiding officer showing bias in the conduct of the trial (Du Toit et al., 2021). Such irregularities, if substantial, may render the trial unfair and thus justify an appeal. By contrast, a mere technical irregularity that does not materially affect the outcome of the trial will not usually succeed as grounds for appeal (Burchell, 2016).
