(a) What are the common-law requirements for the duty of support between
spouses?
At common law, a civil marriage creates a reciprocal duty of support between
spouses. This duty applies from the start of the marriage until its termination. However,
the duty is enforceable only if the spouse claiming maintenance is in need and the
other spouse is financially able to provide it. This support includes accommodation,
food, clothing, medical care, and other basic necessities. The extent of the duty is
determined by the spouses’ social status, financial means, and the cost of living at
the relevant time.1
