Question 1: Can Evergreen Printing Use Rei Vindicatio to Reclaim the
Equipment?
Legal Framework
Yes. The rei vindicatio is a real remedy in South African property law allowing an owner
to recover possession of their property from another person who possesses it without
legal justification. The possessor’s good faith or ignorance is irrelevant.
To succeed in a rei vindicatio claim, Evergreen Printing must prove the following:
1. Ownership of the item
2. That the item is movable, existing, and identifiable
3. That USS Graphics exercised unlawful control at the time of the institution of
the action
1. Ownership
Ownership is determined by legal title, not by possession. The lease agreement
between Evergreen and USS Graphics is key evidence. If it contains a reservation-of-
ownership clause stating the equipment remains Evergreen’s property, legal title is
established. While possession creates a rebuttable presumption of ownership, this can
be overturned by producing the lease. This is analogous to a rental car—possession by
the hirer does not transfer ownership. The lease’s terms therefore satisfy the ownership
requirement.
