Question 1: Define administrative law in relation to public law.
Administrative law is a branch of public law that regulates the exercise of public power.
It governs the legal rules applicable when state organs or officials perform public
functions that affect individuals or groups in subordinate positions. While public law
encompasses broader categories like constitutional and criminal law, administrative law
specifically addresses the legality, reasonableness, and fairness of decisions made by
public authorities. It ensures that state power is not exercised arbitrarily and that
affected individuals have legal remedies.
Question 2: Identify all sources of administrative law and indicate whether they
are authoritative or persuasive in nature.
Administrative law draws on multiple sources, categorized as either authoritative
(binding) or persuasive (non-binding but influential):
1. The Constitution (Authoritative)
As the supreme law, the Constitution (especially section 33) guarantees the right
to just administrative action. All administrative laws must comply with its
principles, making it the primary source.
