1. Illegal miners (zama zamas) are found increasingly in South Africa.
They work in abandoned and de-commissioned mines. As long as the
owner of the mine has not obtained a closure certificate, it remains
responsible for the health and safety at the mine. With reference to
the above statement, discuss in full, the duty of an employer at a mine
not being worked in terms of the MHSA. (10)
The Mine Health and Safety Act (MHSA) in South Africa outlines the responsibilities of mine
owners, even for mines that are not currently operational. Here are the key duties of an employer
regarding abandoned or decommissioned mines:
, 1. Health and Safety Management
The employer must ensure that health and safety measures are in place to protect any
individuals who may enter the mine, including illegal miners (zama zamas). This
responsibility is maintained until a formal closure certificate is issued by the Department
of Mineral Resources and Energy (DMRE).1
This includes conducting risk assessments and implementing necessary safety protocols
to mitigate potential hazards.2
2. Closure Certificate
The mine owner is responsible for obtaining a closure certificate from the DMRE. Until
this certificate is obtained, the employer retains responsibility for the mine's safety.
3. Maintenance of Infrastructure
The employer must maintain the mine's infrastructure to prevent hazards such as
collapses or exposure to toxic substances. Regular inspections should be conducted to
identify and mitigate risks.
4. Access Control
The employer should implement measures to restrict unauthorized access to the mine.
This may include fencing, signage, and surveillance to deter illegal mining activities.3
5. Emergency Preparedness
