Chapter 1 introductional Law.

Who you vote for and who goes to congress. Some states have judges , in NJ they are appointed.Caees decide if a
rule is common law.

Where do we see law? Everywhere

Federal view and State View federalism: we need the law to be predictable, precedent can be overruled.

- Article 1:congress is compromised of the senate and house of legislative bill that goes to the president but
if there’s a veto you need two thirds majority of both houses
- 435, senate only has 100



- Article 2: creates the executive branch
- President is head of it



- Article 3 judicial branch Supreme Court which measures any law.
- Stare decisive ( let the decision stands)
- Precedent is binding on other cases( it’s not absolute )

Senate approves and also approves treaties (international law)

Administrative law is a large part of and a source of law . An agency is DMV. Which are created by congress.

Agency has the power to create laws which are called regulations. A specified functions which interpret the laws or
rulings. IRS is a great example.

Criminal and civil law. Some of our laws are base on moralities . How would you make an agreement on civil law..

the largest number of individuals
- Critics of utilitarianism argue that it is exceedingly difficult to measure utility
accurately, difficult o measure utility accurately.
Rawlsian Justice. Realism Justice: Rawls argues that everyone should have
the opportunity to earn great wealth so long as the tax system provides
enough revenue to provide decent health, education, and welfare for all. John
Rawls: We are born as life prospects where luck matters. We should have a
