Introduction – Costs
The client will be concerned about costs:
- The costs they will incur when preparing the case
- The risk of being ordered to pay the opponent's costs
Costs are a concern that pervades all litigation.
It is likely to be in the parties’ minds at all stages.


The court decides who should pay costs that have already been incurred.
The court makes that decision after an interim application and a trial. Here the
court decides who should pay the costs of the interim application and the
litigation.

- The amount of those costs
- When they are paid


Costs procedure
Once the parties have determined that one party must pay another party by way
of costs, there are two ways the court can decide the precise amount of costs
through two assessments
- Summary assessment - simpler
- Detailed assessment – complex


Interim costs order
Explains how the court might exercise its powers with some particular types of
order only available when determining costs following an interim hearing.
