Access to children's court case records in terms of the Promotion of Access to Information
Act 2 of 2000:
a) PAIA allows for access to children's court case records, but the Children's Act 38
of 2005 prohibits public disclosure of children's identities in court proceedings.
b) Access can only be granted if the child's identity is protected.
c) The requester must submit an application for access to the court where the case
was heard or to the Department of Justice and Constitutional Development.
d) The court or Department may refuse access if it is not in the best interests of the
child or if it would compromise the safety or privacy of the child or any other
person.1
