1. What law currently regulates the attorney’s profession in South Africa?

The legal profession in South Africa is currently regulated by the Legal Practice Act 28
of 2014. This law replaced the old system where different provincial law societies
governed attorneys and advocates separately. Now, the Legal Practice Council (LPC)
oversees all legal practitioners in the country.




2. What is the function of the Legal Practice Council (LPC)?

The Legal Practice Council (LPC) is responsible for regulating and overseeing
attorneys and advocates in South Africa. Its job is to make sure that legal
professionals follow the rules of the profession, act ethically, and provide good services
to the public. The LPC also has the power to discipline legal practitioners who do not
follow the rules.




3. What was the issue for determination in this case?

The main issue in the case of Law Society of the Cape of Good Hope v Buricks was
whether Mr. Buricks, an attorney, was guilty of misconduct and if he should be
removed from the roll of attorneys. The court had to decide whether his actions were
serious enough to prevent him from continuing to practice law.
