Unit 14 P1
Describe the diferent ttpes of emplotment contract P1

Contract

Contract is an agreement between 2 or more people that is enforced bt the law and must meet the
same essental requirement. Ien order to form a contract law should include which is the ststem of
rules which a partcular countrt or communitt recognizes as regulatng the actons of its members
and which it mat enforce bt the impositon of penaltes. onopolt power is included which is
defined as a single seller of a product(o i.e. 100% of markeet share enforcement should include
which is the act of compelling observance of or compliance with a law, rule, or obligaton as well as
idea of justce which is Fairness in protecton of rights and punishment of wrongs. While all legal
ststems aim to uphold this ideal through fair and proper administraton of the law of the land, it is
possible to have unjust laws.

Requirements of a contract

Ien order to meet the requirements of a contract, areas such as ofers, acceptance, intenton,
consideraton, capacitt and legalitt have to be gone through between 2 or more people. Ief the
requirements are not met a contract won’t be formed. Acceptance in a contract must be certain,
not uncertain, the mind must meet (oi.e. Acceptance on hourlt wage intentons where familt
member / friend cannot be the one makeing a contract consideraton which is something of value
must change hands or promises to the future capacitt where minors, intoxicated people, insane,
vulnerable or duress under infuence must not be signing a contract as well as legalitt where
contracts should not be in means of exchange of illegal goods such as marijuana.

ethods to emploting a staf (opart tme / full tme

There are various ttpes of wat a staf can be emploted which HR needs to kenow, this mat include
full tme and part tme. For example, business likee Tesco can emplot stafs on full tme this means
that Tesco is signing a contract to give full tme job to an emplotee. Emplotee who have signed the
contract will have to be provided with 35 hour a weeke and if business likee Tesco does not provide
them with the right amount of hours than the emplotee who signed the contract have the right to
sue or demand for more hours .However in the other Ief an emplotee is signed under a part tme
contract , emplotee should have at least 8 hours of worke per weeke and not more than 30 hours a
weeke if signed under part tme contract because this is against the Protecton of Emplotees (oPart-
Time Worke Act, 2001. Business likee Tesco can be sued for giving an emplotee more hours to worke if
thet are signed under part tme contract.

ethod of emploting a staf (o fixed term / agenct

There is also fixed term contract as well as agenct contract these ttpes of contracts are diferent on
their own wats which HR needs to kenow. For example, business likee Tesco can get an emplotee on
fixed term contract which means it has a start and end date where the contract Terminates
automatcallt when a partcular taske is completed or when it reaches the end of the contract.
Emplotees won’t be able to leave Tesco unless there is a vital reason that thet must leave such as
going abroad. This also means that Tesco will be able to do a new contract afer the expiraton date
where the emplotee is also protected bt The Protecton of Emplotees (oFixed Term Worke Act 2003.
