Administrator - ANSWER-The individual designated by the licensee to act in behalf of
the licensee in the overall management of the facility. The licensee, if an individual, and
the administrator may be one and the same person.
Advance Health Care Directive - ANSWER-Written instruction that relates to the
provision of health care when an individual is incapacitated.
Ambulatory Person - ANSWER-Person who is capable of demonstrating the mental
competence and physical ability to leave a building w/o assistance of any other person
or without the use of any mechanical aid in case of an emergency.
Basic Services - ANSWER-Those services required to be provided by the facility in
order to obtain and maintain a license. Includes safe and healthy living place, personal
assistance and care, observation and supervision, planned activities, food service,
arrangements for obtaining incidental medical and dental care
California Clearance - ANSWER-Individual has no felony or misdemeanor convictions
reported by the CA DOJ. However, may have been arrested w/o criminal conviction,
convicted of minor traffic offense or adjudicated as a juvenile.
Capacity - ANSWER-Maximum number of people authorized to be provided services at
any one time in any licensed facility.
Care and supervision - ANSWER-Those activities which if provided shall require the
facility to be licensed. It involves assistance as needed with ADLs and the assumption
of varying degrees of responsibility for the safety and well-being of residents. Shall
include but not limited to, assisting in dressing, grooming, bathing, and personal
hygiene;
assistance with medication, central storing and distribution of medications;
Arrangement of and assistance with medical and dental care, may include
transportation;
maintenance of house rules for protection of resident;
supervision of resident schedules and activities;
maintenance and supervision of resident monies or property;
monitoring food intake or special diets.
, Certificate holder - ANSWER-A person who has a current administrator's certificate
regardless of whether the person is actually employed as an administrator in a facility or
not. DIFFERENT FROM CERTIFIED ADMINSTRATOR
Certified administrator - ANSWER-Administrator who has been issued a RCFE
administrator certificate by the Dept and whose certificate is current.
Close Friend - ANSWER-A person who is attached to another by feeling of personal
regard as indicated by both parties involved
Community Care Facility - ANSWER-Any facility/place/building providing nonmedical
care and supervision
Conservator - ANSWER-Person appointed by the Superior Court to care for the person
or estate, or person and estate of an adult.
Consultant - ANSWER-Person qualified by training and experience to provide expert
information on a subject.
Control of property - ANSWER-The right to enter, occupy and maintain the operation of
the facility property within regulatory requirements. Evidence shall include but is not
limited to, a Grant Deed showing ownership; lease or rental agreement; or court order
which shows the authority to control the property pending outcome of probate
proceeding or estate settlement.
Criminal Record Clearance - ANSWER-An individual has BOTH California clearance
and FBI Clearance
Deficiency - ANSWER-Any failure to comply with any provision of the RCF Act for the
Elderly and regulations adopted by the Dept. pursuant to the Act.
Serious Deficiencies - ANSWER--fire clearance, #/type of residents, telephone service,
residents with prohibited health conditions, non ambulatory residents, restraints, safety,
food storage, preparation and service, medicine storage/dispensing, hot water
temperature, bathroom, storage of needles and waste, night supervision,
Delayed Egress Device - ANSWER-A special egress-control device of the time delay
type. H&S code: exit doors in facilities classified as Group R Div 2 facilities, licensed as
RCFEs and housing clients with AD or dementia, may be equipped with approved list
devices provided the building is protected by automatic sprinkler system and approved
automatic smoke-detection system. Delay not to exceed 30 seconds. Unlatching shall
not require more than one operation. Sign with instructions required.
Dementia - ANSWER-Loss of intellectual function (thinking, remembering, reading,
