IS TEXTUAL INTERPRETATION OF STATUTE MORE USEFUL THAN CONTEXTUAL INTERPRETATION? Background Parliament as organ of the state has authority to pass laws. The laws are debated and formulated under the auspices of Parliament. Since Parliament is the drafter of legislation, one could assume that it would be logical to read the rules in a a piece of legislation in a textual manner to ascertain the intention of the legislature. This is generally referred to as the ‘orthodox’ or ‘textual interpretation of legislation’. This, however, is not the only method of interpretation. There is ‘contextual (or purposive) interpretation’ which involves several techniques to interpret any legislation. This may include factors that do not necessarily form part of the interpreted legislation. If then Parliament is responsible for formulating and drafting legislation, why would there be a need to consider factors that do not form part of the legislation? Would this undermine Parliament’s authority and its function as the lawmaker? Moreover, would this not create counter-majoritarian difficulty? Considering that South Africa is a Constitutional State, conduct research and provide your own opinions on whether textual interpretation or contextual interpretation is best suited for South African law

, SUMMARY

In the realm of legislative interpretation, two predominant methods exist: textual and
contextual. The former involves interpreting laws based on their written words, often
seen as the 'orthodox' approach. The latter, known as contextual or purposive
interpretation, considers various factors beyond the text to determine legislative
intent. While Parliament drafts laws, contextual interpretation doesn't necessarily
undermine its authority; rather, it aims to ensure that laws achieve their intended
purpose and adapt to changing circumstances. This approach might involve
considering historical context, societal values, and legislative objectives. In a
Constitutional State like South Africa, the choice between these methods depends
on the balance between upholding parliamentary authority and fulfilling the
constitution's intent. Contextual interpretation can enhance the responsiveness of
laws to evolving needs, making it a viable option in South African law alongside
textual interpretation, promoting a harmonious coexistence of both methods.
