Introduction
A legislation is made up so that everyone understands what behaviours are
acceptable when working in any health and social care setting. An example is the
Health and Safety at Work Act. It covers aspects of an individual’s health, safety and
wellbeing including people who work in the setting and those affected by the
activities carried out in the setting. For example, service users and visitors. The
purpose of legislations is very self-explanatory. This is because they are made to
safeguard both health and social staff, service users and the wider public who might
be affected the services they provide.
Also, policies and procedures set rules, guidelines and principles and how they
should be followed to carry out a particular assigned task and to help in decision
making. Even though Policies and procedures works alongside each other, they
have individual purpose in health and social care. The purpose of policies in any
health and social care setting is to set general plans of action in the setting. It also
makes the staff understand their roles and responsibilities in the setting. Procedures
on the other hand, procedures are developed internally by health and social care
settings to show how policy can be followed and how they can deliver services to
service users.
Even though both legislations, policies and procedures have individual roles they
play in any health any health and social care setting, they work together to ensure
the safety of both staff and service users in the setting, ensure that staff in the setting
understands the need to act in the best interest of service users and the complication
associated when they fail to act in the best interest of their service users. Aside that,
it ensures that staff understand their roles so that they will be able to take on tasks
based on their strengths and weakness in other to promote the quality of care and
support they provide in the setting and to make sure that it is in tune with the needs
of the service users.

In all when legislation, policies and procedures work alongside each other, it
promotes safeguarding and improve the quality of care and support delivered in the
setting.
In this section, I will be focusing on The Health and Safety Act at Work Act, The
Control of Substances Hazardous Health, safeguarding policy and complaints policy.
I will be covering aspects about how they influence practice in firs residence.

THE HEALTH AND SAFETY AT WORK ACT 1974
This legislation set a legal framework to ensure the safety of staffs, service users
and others who might be affected by the activities carried out in any health and
social care provision. It places a responsibility on both employers and employees on
the role they play in safeguarding the vulnerable individuals under their care. What
employee and employers need to do to ensure the safety of the safety of their
service users is highlighted under the Health and Safety at Work Act. Also, the Act
covers a range of matters relating to workplace health, safety and welfare of both
service users, staffs and even people who might be affected by the activities carried
out in the setting. It does this by setting out a more detailed responsibilities of both
employees and employers in different areas about health and safety. It also brought
together must of the existing legislations that also relates to health and safety. For
example, the Manual Handling Operations Regulations 1992. This happens because
as time changes and technology develops, the risks of the workplace change. Now,
this is managed through approve code of conducts, drawing some emphasis on the
framework and intent of the entirety of the Act.
