Restorative Justice
All parties such as the relatives of the deceased, victims, parolees, and the
community involved in a particular offence are brought together by the restorative
justice process. The Department of Correctional Services actively participates in
holding the criminal accountable for their wrongdoings as restorative justice is a
strategy that emphasises reconciliation rather than punishment. By providing
offenders the facility to take accountability for their actions, restorative justice allows
them to make reparations with the people they have wronged to be accepted back
into their community. Not only is restorative justice crucial for parole, but it also
recognises the significance of societal community members and the role they play in
aiding the rehabilitation process. Victim-offender discourse sessions, bargaining, and
resolving difficult problems are used in this process. Family members of the
deceased, the victim of the crime as well as the community the crime has been
committed all participate in restorative justice to receive a fair outcome in order to
bring peace and satisfaction that will then safeguard the community and uplift the
parties involved and effected by the crime.
Restorative Justice Video
Brutal and vicious murders like the one shown in the video above, divide
communities with conflicting beliefs and separate themselves from the perpetrator
that committed the crime. The offender must confess to their wrongdoing,
demonstrate a willingness to repent, and make amends with the victims to heal these
community relationships. The community should support the offender in their quest
for rehabilitation, and the victims should be willing to forgive. This is evident in the
video because, the parolee, Mr Mzwandile Mtshelwa, and the other offenders had a
chance to ask the community for forgiveness. Life sentences were issued to every
criminal involved. Mr Mzwandile further clarifies that he was the one who shot Mr
Madolo and that his boss from the taxi association directed him to do so. He then
conveys remorse for his wrongdoings and asks for forgiveness from his community
and from Mr Mandolo’s wife. Mrs. Nthobekhaya admitted that raising her children
alone is difficult because Mr. Madolo was the family's primary provider. However,
she said she has come to terms with the fact that her husband is no longer alive and
is enduring the consequences of his death and forgiveness will be granted.
